Businesses Hit with Hefty Fines for Illegal Waste Disposal

Two businesses in Cornwall have been fined thousands of pounds after failing to provide evidence of legal waste disposal, resulting in significant costs.

Fines for Failing to Provide Waste Transfer Notes

On 8th October, Daniel Manning, the proprietor of Sea Dogs Barbers in St Austell, appeared at Bodmin Magistrates’ Court. Daniel pleaded guilty to not providing waste transfer notes when requested by Cornwall Council. The business was fined £1,000 and ordered to pay an additional £2,500 in costs.

Similarly, Dave Lee, owner of Little China in Mevagissey, also faced Bodmin Magistrates’ Court on 8th October. Dave pleaded guilty to the same offence of failing to provide waste transfer notes. Little China was fined £1,000, along with £2,000 in costs.

Legal Responsibilities for Businesses

Businesses of all types, including retail shops, holiday rentals, and food establishments, are legally required to properly manage their waste disposal. Under Section 34 of the Environmental Protection Act 1990, businesses must ensure that their waste is disposed of by a licenced waste disposal service, with records kept for a minimum of two years. Cornwall Council had previously offered both businesses the option to pay a Fixed Penalty Notice, but after no response, the cases were brought to court.

Waste Misuse and Penalties

Councillor Martyn Alvey, portfolio holder for environment and climate change at Cornwall Council, reminded businesses that household waste services are funded by taxpayers and should not be used by businesses. Businesses must set up contracts with registered waste carriers to ensure they are in compliance with the law.
