Police Clarify Legal Requirements for E Bikes in Cornwall

Know the Rules or Risk Losing Your E Bike

St Austell Police have reminded riders that not all electric bikes are legal to ride on public roads or paths without a licence, tax or insurance. With e bike use on the rise, officers have issued a warning that only certain types are classed as Electrically Assisted Pedal Cycles (EAPCs) under the Road Traffic Act 1988.

To be legal as an EAPC, the bike must meet specific requirements. If it does, it can be used like any other pedal cycle on roads, cycle paths and bridleways. Riders must also be over the age of 14.

Not All E Bikes Are the Same

Police are urging riders to check whether their e bike qualifies as an EAPC. If it doesn’t, it’s classed as a motorcycle. That means it must be registered, taxed and insured, and the rider must have a valid driving licence and wear a motorcycle helmet that meets British safety standards.

Crucially, these types of e bikes can only be used on roads. Riding one on a path or bridleway is not allowed.

Seizures and Prosecutions Possible

St Austell Police say that riders failing to follow the rules may face prosecution under the Road Traffic Act. Officers also have the power to seize e bikes that do not meet the legal requirements.
